Kirby’s Terms of Service
GENERAL
♡ Please review Terms of Service before you request your commission
♡ Most questions can be answered through these Terms of Service and commission forms
♡ When you purchase your commission, that means that you agree to the artists terms
♡ When commissioning the artist, understand that you are requesting THEIR style. Do not ask the artist to emulate another style.
WILL AND WILL NOT DRAW
♡ WILL draw:
- Humans, Humanoids, Monsters, Furries, OCs, OC x Canon, Yumeships, Simple Mecha / Armor, Mild NSFW (pinups, nudity, suggestive)
♡ WILL NOT draw:
- Problematic / Offensive, Proship, Fetishes, Heavy Mecha, Heavy Gore, NSFW (sex and sexual activity)
If not listed and you're unsure, feel free to ask.
DEADLINES AND DELIVERY
♡ Commission times will depend on the artists queue
♡ Commission requests can take 2-4 months to complete
♡ Rush fees are available if the client has a specific deadline or would like their commission sooner than estimated time
PAYMENTS
♡ All payments will be made through VGen, PayPal, or Stripe Invoicing
♡ Commission payment must be made within 24 hours of your request. Non-payment will result in rejection of your request.
PAYMENT PLANS
♡ Short term payment plans are available for commissions $250+
♡ Plan Options:
♡ 2 Installments
- "2 Part installment plans" are allowed for commissions of $250 or more. MUST be paid completely within 2 weeks of the first deposit.
♡ 3 Installments
- "3 Part installment plans" are allowed for commissions of $600 or more. MUST be paid completely within 4 weeks of the first deposit.
♡ 4 Installments
- "4 Part installment plans" are allowed for commissions of $1,000 or more. MUST be paid completely within 6 weeks of the first deposit.
First deposit must be paid within 24 hours of acceptance
♡ Clients receive 5% off of their commission for early payoff. Reach out to artist before making the early payoff to see if you're eligible and to request this discount.
♡ There is a grace period of 3 days after the installment due date to make the payment. If the client feels they need more time, please communicate with the artist.
♡ Plan deposits are non-refundable. If the client chooses to no longer pay on their plan, the commission will be canceled.
LOYALTY CARDS
♡ Loyalty cards are not accepted for some commissions
♡ Loyalty card max discount: $100
♡ Loyalty cards are not accepted for the following:
- Commissions that are on sale or discounted by the artist
- Commissions that state "Loyalty Card Accepted?: No"
- Commissions that are for "Commercial Use"
REVISIONS AND ADJUSTMENTS
♡ The client is allowed 2 free simple revisions during the sketch and line art phase
♡ Client is allow to request 2 free color adjustment during the flat color phase (may be asked to provide HEX codes)
♡ Client will be subjected to a "Adjustment Fee" of $5-30+ if:
- Adjustments exceed the 2 free revisions during the sketch and lining phase
- Adjustments requested during and after the flat color phase
If the client requests to change references during these processes:
- Sketch completed: Fee of 30% the commission cost
- Line art and / or flat colors completed: Fee of 50% of the commission cost
- Rendering in the work / completed: Fee of 75-100% of the commission cost
Client has 3 days to request revisions after their request has been completed.
- Revisions will result in an "Adjustment Fee" of 30-100% of the commission cost
REFERENCES AND DESIGN
♡ The client is responsible for providing ALL references for their request, such as:
- Poses, outfits, hair, body type, and overall look of the character
♡ The artists responsibility it to take those references and put them together into an illustration in their style.
♡ The artist will only provide a design for the client for a extra fee:
- Partial design: 50-75%
(artist will design an outfit for the client or help slightly redesign an existing character)
- Full design: 100%
(artist will do a full character design for the client)
PRICING ADJUSTMENTS
♡ All commissions have a base price, but are subject to change
♡ Pricing adjustments may be made by the artist based on the complexity of the clients request
USE
♡ Personal Use: For clients who would like to purchase art for themselves, a gift, or a profile picture on a non-monetized platform and do not plan to use the digital asset for any monetized purpose
♡ Content and Ads: For content creators and businesses who want to use the commission asset as part of creating and distributing commercial and monetized digital content
- This includes, but is not limited to banners and profile art for any monetized social media platform (Twitch, YouTube, Instagram, etc.)
♡ Merchandise and Reselling: For businesses who want to create, promote, and re-sell their own digital or physical end products made with the commissioned asset
♡ RULES:
- Prices will vary based on the style and complexity of your commission
- DO NOT Re-sell the commissioned asset “as-is” without any value-add activities
- DO NOT claim credit, ownership, or copyright over the commissioned asset
♡ If the commission assets are used in a manor that is not agreed upon between the client and artist, the artist has the right to press charges for $1,000 + any monetary gain from the usage of assets
AI USAGE
✖ Using the commissioned asset for AI is STRICTLY PROHIBITED
✖ You are not to use AI tools to enhance or change the artists work. You are not allowed to use the artists art in AI by ANY means. This includes putting the art through AI tools such as: Chat GPT, Gen AI, Grok, Sora, etc.
✖ If the artists work is used for AI, charges will be pressed of $1000 to you.
✖ This rule applies to past, present, and future commissions.
INTELLECTUAL PROPERTY RIGHTS
♡ The artist maintains the rights to all commission assets
♡ The artist maintains the rights to post the commissioned assets to their social media as well as their portfolio
♡ The artist maintains the right to resell commission as print
- If the artist chooses to sell art books or digital + physical media in the future
♡ If the commission includes an NDA, the artist will not post the work to any platform until the approved time by the client
♡ The artist must be credited on their work, including commercialized assets.
REFUNDS
♡ Refunds and cancelations are not accepted if it is prior to the due date or still in the works after the due date
♡ Chargebacks are prohibited at any point and will result in the client being blacklisted
♡ Refund is accepted if the due date has been exceeded by 2 weeks with no communication, work has not begun, and the client chooses not to accept an extended date
♡ If the client chooses to request a refund during the accepted times, please be aware that it may take 1-2 months to receive your refund from the artist
COMMUNICATION
♡ Your commission will go into WIP status in the month your request is due
♡ The artist will reach out 2-5 days prior to your commission due date to begin providing "Work IN Progress" (WIPs)Please do not harass the artist about the status of your commission. The artist will reach out to YOU.
♡ Harassment of any kind will result in being blacklisted from commissioning the artist in the future. This may also result in a canceled commission with no refund.
COMPLETING REQUESTS
♡ As it is understandable that we live busy lives, clients are asked to be proactive in reviewing and responding to "Work in Progress" messages within a reasonable time
♡ The artist aims to complete most simple requests within 1-2 days.If the client does not respond to a progress photo within 8 hours, the artist will continue to the next portion
♡ If the client does not respond to an adjustment request within 8 hours, the artist will continue
♡ If the client does not respond to the completed request within 24 hours, the commission will be submitted as complete
♡ If the client asks for changes after completion, the client will be subjected to an "Adjustment Fee" of $20-100+
- Adjustment requests are only accepted for 72 hours after completion.
- If the client still insist on changes (minor or major), the cost will be 50-100% of the commission price.

WHAT IS A
"Loyalty Card"
♡ The loyalty card is used for repeat customers to earn rewards on their commissions.
♡ The client MUST be a past commissioner to purchase a card
HOW TO USE A
"Loyalty Card"
♡ With each commission that you submit, you must also upload your loyalty card to be stamped.
♡ With each stamp, you'll be able to use the "unlocked / stamped reward" on your next purchase.
♡ You may only apply 1 discount per commission. Discounts may not be doubled up.
DOES THE
"Loyalty Card"
APPLY TO PAST COMMISSIONS?
♡ No, the card is applied for all commissions AFTER card purchase.
DEADLINES AND DELIVERY
♡ Please allow 24 hours for your card to be made and provided to you.
USE
♡ All cards are good ONLY for commissions by KirbyStomping.
♡ Cards expire after 2 years. If your date of purchase (DOP) is 01/01/2026, your date of expiration (DOE) will be 01/01/2028
♡ Once your card is filled or expired, a new card must be purchased to continue earning rewards.
